A federal judge on Wednesday ordered a federal judge to order the U. S. Food and Drug Administration to stop selling the erectile dysfunction drug Viagra, a prescription drug, after it was found to contain the same ingredient found in the prescription erectile dysfunction drug sildenafil. U. District Judge James F. Cunlens in Philadelphia last month threw out the lawsuit against Pfizer that it filed last month. The suit was filed by plaintiffs who allege that the company has engaged in fraudulent scheme that allegedly improperly shipped Viagra and other drugs from foreign countries to the U.
“If a drug manufacturer can conduct a fraud that violates U. law, then that is the end of the matter,” said Judge Rebecca Doerstler in a news release.
FDA spokeswoman Julie A. Mancusi said the company “is not a party in this case.”
“The company’s actions are not inconsistent with the U. Food and Drug Administration’s approval of sildenafil as a drug for erectile dysfunction,” she said.
Viagra, which Pfizer marketed as Viagra in 1998, is the only FDA-approved drug for erectile dysfunction. In the case of a lawsuit, the FDA alleges that Pfizer’s drug was found to contain sildenafil and is not safe.
In June, the FDA issued a warning that the drug had been found to contain an undeclared drug substance known as PDE5 inhibitor (sildenafil). The warning also warns of possible heart risks, including pulmonary embolism, which may be life-threatening if left untreated. The warning is only issued when Viagra is taken with nitrates.
The complaint alleges that Pfizer marketed Viagra and other drugs for the treatment of pulmonary arterial hypertension and erectile dysfunction.
The suit also asks that the FDA remove Viagra from the market.
“To date, the FDA has not determined that Viagra is safe, effective or suitable for the treatment of erectile dysfunction,” said the FDA’s director of enforcement, Janet Woodson.
The suit seeks to prevent the FDA from issuing a warning about the drug’s safety, according to Pfizer.
The complaint filed in Philadelphia on behalf of plaintiffs, which are suing Pfizer for allegedly failing to warn consumers about the risks of using Viagra, says that the FDA has not received any reports of serious adverse events related to Viagra or other drugs in the U. and that the agency has not issued a warning about the drug.
The company says in a statement that it has “always approved sildenafil to treat erectile dysfunction.”
In a press release from the company, Pfizer said, “Patient safety is our top priority, and our safety officials are well-equipped to address the safety concerns that come with using this medication.”
The company said that in the future, the drug will be sold only to patients who already have severe heart problems.
“Pfizer believes that patient-level information on the effects of sildenafil, its risks and benefits, is a useful tool in the medical community,” said FDA spokesman Robert Houser.
“We will continue to monitor the safety of sildenafil as needed,” said the FDA.
The FDA also is asking for a letter from Pfizer to the FDA’s director of enforcement, asking that he “not be sued for introducing new information” and that it not allow Pfizer to withdraw sildenafil from the market.
The company has a policy of only allowing drug companies to promote their products without a prescription. Pfizer, however, has said it will continue to market sildenafil for erectile dysfunction and it will not provide Viagra or other drugs to patients.
